Criminal liability for bad reviews? Is it real?

Hello :waving_hand:

Please tell me :folded_hands:

I received a message today!

" Do you know that you can be imprisoned for bad reviews?"

I always write honest reviews, I don’t insult anyone, and I ask specific questions to improve and develop myself, not to blame anyone specifically.

Should I be concerned? Have there been any court cases related to comments?

Thank you

Hi @Daria_Ernestovna , thank you for asking.
Generally speaking I would say no, you can’t, but of course it depends of the country where you are.
Of course a business can call you to the court if the think that the review is defamatory, and if the court decides that the defamation is causing a damage to the business the judge in some cases can put you in jail. But of course it depends on the local laws, and there are countries where you can be arrested.
In 2020 an American citizen was arrested in Thailand after a negative review on an hotel. In that country the law that protects the businesses against defamation is quite strong.
So my suggestion is to check the local laws, depending on the country where you left the review

What do you exactly mean, @AbhijeetUniyal ?
Posting negative reviews is perfectly fine, that’s why we have the possibility to rate a business from 1 up to 5 stars.
But of course a review should be respectful and constructive.

However in many countries there is a strong and restrictive law to protect the businesses, and the businesses often take advantage of this to have the reviews removed.
This is not something that Google can control/manage, other than removing a review if (like in Germany) the platform where the reviews are hosted is considered responsible for the review

In addition, @Daria_Ernestovna , as you posted a question, I am changing the category of your post to Google Maps tips & tricks - Local Guides Connect, where it fits better

Hello, @ErmesT!

Thank you for your detailed response.
I understand that it is necessary to know the legislation and not to interfere with people’s work by making any changes.
Although this is the second time I’ve received threats for my reviews. Despite the fact that I don’t insult people, I point out specific facts and flaws that need to be addressed and changed. If a company provides poor services, why would anyone want to do business with them? I’m very upset about this. Business for business is a thing of the past. Everything is changing. Apparently, my topic about the meeting in Thailand is particularly relevant, as people need to be aware of not only the technical aspects but also the associated risks. Do I need to contact a lawyer and get advice about my reviews?

Oops, @Daria_Ernestovna
I am realizing now (sorry) that you are located in Thailand.
I suggest you to read Defamation in Thailand as a form of slander or libel
Defamation as a criminal act in Thailand is defined by the Thai Criminal Code as a statement made by a person who imputes anything to another in a manner that is likely to impair the reputation of the latter or to expose him to hatred or contempt
"In Thailand, it is not the duty of the victim or the prosecution that the statement made by the defendant is false. Hence, the burden of proof lies on the defendant to prove that his statements are true. "

Did you received the message from the business?
If your statement is true you will have to demonstrate it.
IMHO if it wasn’t true you will not have received that message with the attempt to intimidate you, but directly a call from the police. However, even if you can demonstrate what you wrote, the whole procedure can be quite annoying.

Thank you very much @ErmesT . I understand. There have been no messages from the police. In that case, it’s honestly easier not to write and it’s better to delete the review. Karma will take care of it :folded_hands:

Hi @Daria_Ernestovna

I think you made a sensible decision.

Other Local Guides finding them selves in a similar situation might interprete all the praise emails from Google that Google will have your back and help you should you face legal problems. This is not the case. Local Guides are responsible for their actions and reviews. Google is too big to care about all of us volunteers individually. And they are likewise allies with the businesses on Google Maps. Some of the businesses do pay Google for advertising on Maps. So Google is very unlikely to get involved.

Sure, @Daria_Ernestovna . Take care of yourself.

Hello, @ErmesT

No, I will not delete the comments

Because I always write the truth, and I don’t try to humiliate or insult anyone. Those are two different things.

Thai law will be on my side in this situation. I need a volunteer contract for this program Local Guide.

Do you know where I can get one?

Hello @AbhijeetUniyal,

I have removed the solution from your reply as only topics that have absolute answers should have accepted solutions. Please read this article for more information on the topic: How do I mark replies as solutions?

Ok @MoniDi I totally agree with this but what about the badge, as I have received the New Solutionist Badge. How I can remove that badge from my account??

Hi @AbhijeetUniyal,

You don’t need to do anything. The system will automatically remove it.
